These terms are an agreement between you ("you", "the owner") and My PA ("we", "us", "our"). We've written them in plain language. If anything is unclear, email support@mypa.ng and we'll explain.
1. Accepting these terms
By creating an account or using My PA — whether through the app, the web dashboard or any API — you agree to these terms and to our Privacy Policy. If you are using My PA on behalf of a business, you confirm you have authority to bind that business to these terms.
2. Your account
- You must provide accurate registration information and keep it up to date.
- You are responsible for keeping your login credentials secure. Do not share your password.
- You are responsible for all activity that occurs under your account.
- You must connect messaging numbers and pages that you own or are authorised to manage.
- One account per business. You may not create multiple accounts to circumvent plan limits.
3. Using the service properly
You agree not to use My PA to:
- Send spam, unsolicited bulk messages or misleading communications.
- Impersonate another business or person, or misrepresent your products.
- Violate WhatsApp's Business Policy, Meta's Platform Terms or any applicable Nigerian law.
- Attempt to reverse-engineer, scrape, or disrupt the service or its infrastructure.
- Use the service for any activity that is illegal, fraudulent or harmful.
We may suspend or terminate accounts that breach these rules, with or without prior notice depending on the severity.
4. Messaging platforms
My PA operates through the official WhatsApp Business API and the Meta Business API (Instagram Direct, Facebook Messenger). Your use of these platforms is also governed by their own policies — Meta's Platform Terms and WhatsApp's Business Policy. You are responsible for the content of the messages your business sends through My PA, and for ensuring those messages comply with platform rules and applicable law.
5. AI-generated replies
My PA uses artificial intelligence to generate replies on your behalf, drawing from the knowledge documents you upload. You accept that:
- AI replies are only as accurate as the knowledge you provide. You are responsible for keeping your knowledge base up to date.
- We do not guarantee that every AI reply will be correct. You should review flagged conversations and have a process to handle escalations.
- The AI is not a substitute for professional, legal or medical advice — if your business provides such advice, you must implement human review before relying on AI-generated responses.
6. Fees & billing
- The Free plan is free with the limits shown on our pricing page.
- Paid plans (Starter, Growth, Business) are billed monthly or annually in Nigerian naira, processed through Paystack.
- Subscription fees are charged at the start of each billing period. All charges are final — see our Refund Policy.
- Prices may change. We will give you at least 30 days' notice before any price change affects your subscription.
- If a payment fails and remains unpaid for 7 days, your account may be downgraded to the Free plan.
7. Cancelling
You can cancel your subscription at any time from your account settings — no contracts, no cancellation fees. Your paid plan remains active until the end of the current billing period. After that, your account reverts to the Free plan. We do not charge you again after cancellation.
8. Your content & data
Your business data — including your knowledge documents, customer records and order history — belongs to you. You grant us a limited licence to process it solely to provide the service. We will not use your content to train AI models or share it with third parties beyond what is necessary to operate My PA, as described in our Privacy Policy.
You are responsible for ensuring you have the right to upload any documents or files to your knowledge base.
9. Service availability
We aim to keep My PA available around the clock and will work promptly to fix any outages. However, we cannot guarantee uninterrupted availability. We are not liable for interruptions caused by WhatsApp, Meta, Paystack, cloud providers, or events outside our reasonable control (including internet outages, regulatory action, or force majeure events).
10. Our liability
My PA is provided "as is" and "as available". To the fullest extent permitted by Nigerian law, we are not liable for indirect, consequential, incidental or special losses, including lost profits, lost revenue or lost data arising from your use of the service. Our total liability to you for any claim arising out of or relating to these terms will not exceed the amount you paid us in the 3 months before the claim arose.
Nothing in these terms excludes or limits liability that cannot lawfully be limited, including liability for fraud or fraudulent misrepresentation.
11. Intellectual property
My PA and its software, design and trademarks are owned by us. These terms do not grant you any rights in our intellectual property beyond what is needed to use the service.
12. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the Nigerian courts.
13. Changes to these terms
We may update these terms from time to time. For material changes, we will notify you in the app or by email at least 14 days before the new terms take effect. Continued use of My PA after that date means you accept the updated terms.
